			<content:encoded><![CDATA[<p><strong>ORDINANCE NO. 8, SERIES 1982</strong></p>
<p><strong>CITY OF MIDDLETOWN</strong></p>
<p><strong>AN ORDINANCE PROHIBITING CERTAIN PUBLIC NUISANCES<br />
AND PROVIDING FOR THE ABATEMENT THEREOF</strong></p>
<p>WHEREAS it has comes to the attention of the City Council that several real property owners within the City limits are not maintaining their property and are allowing weeds, refuge, trash, garbage, and other scrap materials to accumulate on said property, thereby attracting rodents or otherwise causing their property to be a nuisance to the public,</p>
<p>FURTHER, WHEREAS, it is necessary to clean these lots on or before the inset of the winter season and all good faith efforts of obtaining the cooperation of the property owners have failed;</p>
<p>IT IS HEREBY DECLARED, that the elimination of this nuisance is an emergency situation which must be resolved by the City Council immediately.</p>
<p>BE IT ORDAINED BY THE CITY OF MIDDLETOWN THAT:<br />
Section 1: Any excessive growth of weeds such as jimson, burdock, ragweed, thistle, cocklebur or other weeds of like kind, found growing in any lot or tract of land in the City is hereby declared to be a nuisance, and it shall be unlawful to permit any such weeds to grow or remain on any such place.</p>
<p>Section 2: It shall be unlawful for any person owning or occupying real property within the City to permit any growth, refuge, trash, garbage or scrap material to accumulate and remain upon real estate owned or occupied by such person within the City, which accumulation of materials upon the property attracts rodents, or otherwise is a nuisance to the public.</p>
<p>Section 3: It shall be unlawful for anyone to permit any weeds, grass or plants, other than trees, bushes, flowers, vegetables, agricultural plantings, pasture grasses on lots of five (5) acres or more, crops or other ornamental plants to grow to a height exceeding twelve (12) inches any where in the City, and any such plants or weeds exceeding such height are hereby declared to be a nuisance.</p>
<p>Section 4: It shall be the duty of the Mayor or such other person as the City Council designates, by municipal order, to be the Environmental Enforcement Officer to serve or cause to be served a written notice upon the owner or occupant of any premises on which weeds or plants are permitted to grow in violation of the provisions of this ordinance and demand the abatement of the nuisance within ten (10) days of receipt of said notice.</p>
<p>Section 5: If the person so served does not abate the nuisance within ten (10) days, the Mayor or the Environmental Enforcement Officer may proceed to abate such nuisance by sending employees or contractors upon the said property and such expense shall be charged and paid by such owner or occupant.</p>
<p>Section 6: The City shall have a lien against said property for the reasonable value of labor and materials for such weed or vegetation removal. The affidavit of the Environmental enforcement officer or other reasonable responsible officer shall constitute prima facie evidence of the amount of the lien.</p>
<p>Section 7: The affidavit evidencing the amount of the lien shall be recorded in the Office of the County Clerk. This statement shall contain a legal description of the premises, the expenses and costs incurred and the date the weeds or vegetation were cut, and a notice that the City claims a lien for this amount.</p>
<p>Section 8: The said lien shall be noted to all persons from the time of its recording and until paid, said lien shall bear such maximum interest as provided by law, from time to time, Enforcement of the lien shall be according to law.</p>
<p>Section 9: The Clerk of the City of Middletown is authorized to publish this ordinance as required by law.</p>

Byron Chapman</p></div>
<p>J. Byron Chapman was born March 3, 1947 in Logan County, Kentucky.  As a child in rural Kentucky, Byron attended his first five years of education in a one-room schoolhouse and worked on the farm with his grandfather.  After graduation from high school, Byron attended college at Western Kentucky University.  In 1965, Byron wed his high school sweetheart, Freda.</p>
<p>In 1967, Byron went into the United States Army and was stationed at Fort Campbell, Kentucky with the 101st Airborne.  Byron served in Vietnam from 1968 to 1969 with the 20th Engineering Brigade and received several awards including two Meritorious Performance Awards.</p>
<p>After returning from service in Vietnam, Byron and Freda moved to Louisville, Kentucky, where Byron attended Louisville Technical Institute and graduated with an engineering degree.  Byron worked in several engineering firms including Jeff Boat and Ward Engineering and also taught at Louisville Technical Institute.  In 1978, Byron went into business for himself and today, Chapman Heating &amp; Air Conditioning is listed as the 15th largest HVAC form by Business First.</p>
<p>Byron and Freda have two children and 5 grandchildren.  Both of Byron’s children are involved in the families businesses.  Byron is very family oriented and has “family breakfast” every Sunday with his children and grandchildren.</p>
<p>Byron served as a Middletown City Commissioner for 12 years and is currently on his second term as Mayor of Middletown.  Byron is also on several boards; President of Jefferson County League of Cities, Steering Committee of Floyds Fork Watershed (Floyd’s Fork Land Use Committee), Kentucky League of Cities Legislative Committee, Board Member of the Middletown Inn Historic Preservation Corporation and the Vice-President of Kentuckiana Regional Planning and Development Agency (KIPDA) Board of Director’s.</p>
<p>As an Aircraft Commander in the Coast Guard Auxiliary, Byron also flies missions for the U.S. Coast Guard Homeland Security.  He has received several merit awards from both the Coast Guard and Homeland Security for his ongoing service.</p>

<p>When Sam Tucker went on the Historic Commission in 1992, one of his first projects was to press for the renovation of Middletown&#8217;s dilapidated First Gas Station. About 1998, a federal grant in excess of $30,000.00 was approved. Renovation began, but went very slowly. Work on the station finally ceased completely after Sam left the Commission in the year 2000. The lighted outdoor Aetna sign, grease pit, interior walls, fixtures, lexan protective covering to protect the new windows from rock-throwing vandals, interior and some exterior painting was left undone. Immediately after Sam was elected to the Middletown City Commission in 2002, he began pressing to complete the gas station renovation. The Mayor supported Sam and the job was finally finished in June, 2003.</p></div>

<p>Shortly after World War II, on a part of the land it had purchased in 1943 for a firehouse and alarm answering center, the Civic Club erected a War Memorial on the southeast corner of Shelbyville Road at Madison Avenue to honor the service persons who served in the war and who gave their lives for the country. In later years, heavy traffic and absence of parking discouraged viewing of the memorial. In 2003, the Civic Club and the City of Middletown cooperated in the moving of the Memorial to the Wetherby House Park on the East side of the Wetherby House. A rededication ceremony was held on Veteran&#8217;s Day, November 8, 2003, with many of the veterans in attendance whose names were on the memorial. Middletown VFW Post participated in the memorial service.</p>

<p>Built in 1796, The Wetherby House/Davis Tavern is located at 11803 Old Shelbyville Road (Main Street). It is a two-story structure with solid brick, two-foot-thick walls and 23 rooms. Stuccoed in 1922T it was the homestead on a one-hundred acre tract that was originally owned by Esquire William White.</p>
<p>Purchased by Susan Davis in 1841, it operated as Davis Tavern until the 1870&#8217;s. The tavern and hotel was a stage coach stop on the trail that opened the &#8220;West&#8221; and had a 50-stall horse barn southeast of the tavern. Portions of the barn floor can be found today where the barn once stood. Guests included Henry Clay, Breckenridge and France&#8217;s LaFayette who was said to have visited the tavern during his American tour of 1824. The July 23, 1822, Louisville Herald Newspaper commented on the high quality cheese that was served at the tavern. The Wetherby House is listed on the National Register of Historic Places.</p>
<p>In 1860, Dr. Luther Paris Wetherby stopped at the inn for a night&#8217;s rest. He liked Middletown, met Hattie Brown, the innkeeper&#8217;s daughter whose family owned the tavern, courted her and they ultimately married. Luther and Hattie continued to live at the Inn where all five of their children were born. Thus, the Davis tavern became known as the Wetherby House. Dr. Wetherby was born in Moira, New York in 1838, graduated from Vermont&#8217;s Castleton Medical College in 1857 and from Louisville School of medicine in 1858. He served as a surgeon for the Union Army during the Civil War. After his discharge in July of 1862, he returned to Middletown where he continued his medical practice.</p>
<p>When Dr. Wetherby died, his son Luther Paris (Lupe) Wetherby (1867-1956), who lived across the street, became the owner of the Wetherby House. The Wetherby family retained ownership of the building and about three acres of surrounding land until the City of Middletown purchased the house in 2000. The other acreage had been sold for development. As Lupe Wetherby&#8217;s farm and shipping point for Middletown&#8217;s strawberry growers, 6,500 crates of berries were shipped from the Wetherby House front yard in 1938.</p>
<p>Historic Wetherby house has since been renovated and is now Middletown&#8217;s City Hall.</p>

<p>For more than twenty years, Wayne Creighton has dedicated his life to assisting men and women overcome alcohol and drug addiction. Starting in the 1980’s, he volunteered for the Narcotics Alcohol and Drugs Education unit with the Louisville Metropolitan Police Department, and during 1983, he was employed by Court Referral Services in order to provide alcohol/drug education. Wayne began by doing intake and education referrals for clients with DUI violations, which led him to eventually begin leading and instructing discussion groups and educational classes on the subject of substance abuse. That experience led Wayne in 1986 to the Volunteers of America where he began as a case manager and quickly advanced to the program manger. While acting as the program manager of Volunteers of America, he designed multiple residential treatment programs operating with a half a million-dollar budget.</p>
<p>In 1993, Wayne Creighton formed Interlink Counseling Services, Inc., a non-profit organization located in the Okolona neighborhood of Louisville, KY. His goal was to foster a holistic, transitional, living facility dedicated to the physical, social, psychological, and spiritual restoration of homeless veterans around the US. Furthermore, Wayne designed Interlink to provide highly structured and accountable DUI services and marriage and family therapy in a nurturing environment. Since its initial creation, Interlink has blossomed from providing ten transitional living beds to one of the largest homeless veteran programs in the state of Kentucky with over 100 beds. Along with its previous services, Interlink Counseling Services currently provides a non-medical detoxification facility called the Landing Zone, Harmony House, a 90-day intensive treatment program, and Genesis House, a long-term transitional living facility.</p>
<p>In order to provide an opportunity for permanent supportive housing and to ease the transition into independent living for the veterans who have completed the program at Interlink, Wayne Creighton partnered with Serenity Court Apartments and Coventry Commons to construct apartment complexes for low-income housing. Serenity Court Apartments is currently located on Interlink campus property next to the residential treatment center. Additionally, Wayne created a new business called Kentucky Community Health where professional mental health staff could come and acquire their Continuing Education Units, and he himself teaches several workshops each year. As the years progress, Wayne Creighton continues to fulfill his vision of serving those in need within his community. Recently, he has partnered with the governor of Kentucky and Recovery Kentucky to create the Alternative Recovery Center in Campbellsville, which is a 100 bed facility for men recovering from drug and alcohol abuse over 18 years old.</p>
<p>Along with his Ph.D. in Psychology and Master of Divinity, Wayne Creighton is an ordained minister and currently the commissioner in Middletown, KY where he resides with his wife and two daughters. In addition to his business prowess, he has accumulated an outstanding amount of awards and certifications throughout his life along with over 800 hours of continued education training in mental health, substance abuse and addiction counseling, relapse prevention, the special needs of veterans, and business skills. Channel 21 asked him to appear on a regular series in which he gave counseling advice to the viewing audience, and Business Today created a segment where they displayed a biography of Wayne Creighton’s life along with a personal interview. Furthermore, Wayne has published several articles in a series entitled, “Ask the Counselor”, and he received the Businessman of the Year Award during two consecutive years along with the title of Honorary Chairman of the Newt Gingrich 1996 Victory Circle from the National Republican Congressional Committee. Indeed, Wayne Creighton has dedicated his life to helping America’s veterans and those with mental health and substance abuse issues by providing them with a full continuum of care.</p>

			<content:encoded><![CDATA[<p>In an effort to save the city a substantial amount of taxpayer dollars (est. $154,000 yr.) and to reduce wear and tear on our streets as well as reduce air pollution and improve safety for the city, we have elected to reduce trash service from two times per week to once per week effective the second week of July.</p>
<p>If you are currently on the Monday / Thursday trash route your service will be on Mondays beginning July 6th.  If you are currently on the Tuesday / Friday route your service will be on Tuesdays beginning July 7th.   Due to the size and scope of the change a few Tuesday service homes will need to be changed to Monday.  You will be notified by post card if your day will change to Monday.  If you do not receive a card you will remain on Tuesday. Yard waste day will still be on Wednesdays for the entire city and every other week recycling will still be Thursdays.</p>
<p>All residents are entitled to (2) two of the 95 gallon rolling trash carts (the equivalent to 6 old style trash cans), if you would like an additional cart please call ID Customer Service @ 638-9000.  Also, if you would like to sign up for recycling service call City Hall @ 245-2762 and we will inform ID to add your address and deliver a hinged lid recycling cart.</p>
